The consultation was organised by the Illawarra Ethnic Communities Council and chaired by the ECC Executive Officer, Kathy Tzanis. The Public Guardian of New South Wales is the legal guardian of over 1300 people with decision making disabilities. Of these approximately 150 have a diagnosed mental illness. The Australian Psychological Society categorically condemns the practice of detaining child asylum seekers and their families, on the grounds that it is not commensurate with psychological best practice concerning children’s development and mental health and wellbeing. Detention of children in this fashion is also arguably a violation of the UN Convention on the Rights of the Child.

The Optional Protocol to CEDAW was accepted by the UN General Assembly on 6 October 1999 and opened for signing and ratification by national governments that were parties to CEDAW. Its provisions became operational on 22 December 2000.
