The Australian Human Rights Commission (the Commission) makes this submission to the Senate Legal and Constitutional Affairs Committee in its inquiry into the Commonwealth Commissioner for Children and Young People Bill 2010. This submission considers the broad issues raised by the Bill. It does not make a detailed analysis of each proposed provision.

1. The Human Rights and Equal Opportunity Commission (HREOC) welcomes the Minister’s decision to appoint an independent Australian Citizenship Test Review Committee (the Committee) to consider the content and operation of the Australian citizenship test (the test) since its introduction in October 2007.

The Minister must, by written determination, approve a test for the purposes of subsection 21(2A) which examines whether the applicant has satisfied the general eligibility requirements set out in sections 21(2)(d), (e) and (f).
