This report contains a summary of observations by the Australian Human Rights Commission (the Commission) following its July 2009 visit to Australia’s immigration detention facilities on Christmas Island. It follows the Commission’s 2006, 2007 and 2008 annual reports on inspections of immigration detention facilities.[1]

2008-09 has been a year of positive developments in the human rights area. While many human rights challenges lie ahead, as Human Rights Commissioner, I have been excited by the progress that Australia has made in human rights, both domestically and internationally during the year.

Staff in the Social Policy and Advocacy Research Centre, and the Youth Studies Flagship at the Australian Catholic University welcome the Human Rights and Equal Opportunity Commission's initiative in establishing an inquiry into children in Australia's immigration detention centres.

I am pleased to present herewith a submission on behalf of the Association of Childrens Welfare Agencies, addressing key issues for the Inquiry into Children in Immigration Detention.

The Commission's jurisdiction to hear and determine complaints of unlawful discrimination ceased on 13 April 2000 with the commencement of the Human Rights Legislation Amendment Act (No.1) 1999 (Cth) and was transferred to the Federal Court and Federal Magistrates Service. The Commission retained the jurisdiction to complete those public inquiries that had commenced prior to 13 April 2000.

The National Association of Community Based Children's Services (NACBCS) represents long day care, preschool, occasional care and outside school hours care services that are community owned and managed. The members of NACBCS predominantly work in direct contact with children and families in the services and advocate for quality childcare services for young children.

The Youth Justice Coalition (YJC) is a network of youth workers, children's lawyers, policy workers and academics concerned about juvenile justice and working to promote the rights of children and young people in Australia.

ChilOut was established in July 2001 by a group of concerned parents and citizens who felt compelled to advocate and act on behalf of children and their parents living in Australia's immigration detention centres (IDC).

The Social Justice In Early Childhood Group (SJIECG) was formed in 1996 and is made up of early childhood professionals focussed on social justice issues as they relate to children and their families.
