As lawyers who work every day with ordinary people, you will all have first hand experience of the value that we, in Australia, place on human rights. You will also be acutely aware of the significant gaps in human rights protection in Australia.

Despite its rather grand title, this presentation will be a relatively modest attempt to set out the key challenges for human rights in Australia as I see them at the outset of my term as Human Rights Commissioner.
Commission – General
In May last year I stepped down from my position as a Judge of the Federal Court to accept the role as President of HREOC. It has been a time of new challenges, such as the need to balance the legislative and administrative responsibilities that the Commission has been given by the federal government, with the important role of advocating for the rights of those on the margins of Australian society.
Business and Human Rights
Responses to the COVID-19 pandemic have required very quick action by governments. But those responses have also involved significant limitations on people’s rights and freedoms, especially freedom of movement, and implemented through executive power often with limited parliamentary involvement.

Commission – General
This paper addresses one of the Forum themes: ‘Security and Human Rights’. Since 11 September 2001 governments around the world have responded to the threat of terrorism with tough measures to protect the lives and security of their communities – to protect their fundamental human rights. New security measures give government authorities unprecedented powers, which can seriously infringe the basic human rights of those against whom the powers are exercised.

I should add, at this point, that my work over the past few years and my inquiry on children in immigration detention (CIDI), in Australia, the report of which "A last resort?" was tabled in the Australian Federal parliament in May of 2004, has made me even more keenly aware of the fragility of child asylum seekers. But more on that later!

Disability Rights
MATT LAFFAN: I once used to say to some mates of mine that all I really wanted was 24 hours without a disability. I just wanted 24 hours so that I could do certain things. Since then, I've got a little greedy and now I want one week. And during that one week there'd be hell to pay, because Sydney just would not be big enough. I think the night club scene would be in a world of trouble, because dancing is something I'd really like to do. There'd certainly be a rugby match I'd have to get involved with. I'd go running with the old man.

While Australia may have come in from the cold, the wind has been taken from my sails. The typical role of an international lawyer over the last few years, whether in Australia or in the UK, Europe and North America has been to berate their respective government ministers with numerous failings and to list the necessary reforms to policy.
